Got a 330 CI sport 2 weeks ago,

Well tonight driving home in the rain having just come off a roundabout an un-insured new driver lost control coming the other way and smashed into my car doing about 40.

Where do I stand with insurance.. how do I claim?? will I have to go to court to get the money from him?

driver got nicked for no insurance and careless driving!

You will need to contace the M.I.B. (no... not the 'Men In Black' :wink: )

They are funded by the insurance industry and help in these situations.

It might take a while but hopefully they will be able to get things sorted for you.

There's loads of info on the site and well worth a read even for those of us lucky enough not to need their services at the moment.

Shieet Rob thats awful mate, really sorry to hear. Sadly it will be your insurance that has to cough up.

Things like this that make me so angry !!!

Most insurance premiums include amongst the crap you never need, protection againsy un-insured losses. If your fully comp, you might have this along with legal assistance.
Check with your policy AND company, you moght have access to help you're not aware of yet. You'd be very unlikely to have to go to court to get your money, as the fact he's been reported for the accident will go massively in your favour with any subsequent civil proceedings.

Guys, guys

There are three insurance companies in the UK that have a gentleman's agreement with uninsured drivers, Aviva and a couple of others. In these firms cases as long as you have the drivers registration number and his or her details, the accident will be treated as non-fault, and you won't lose your no claims or excess.

Whoever you are with your legal expenses, assuming you didn't delete this option, and as Ady says you can claim through the MIB. I did this a few years ago and it wasn't too bad. You will still lose your NCD and excess in this instance from my experience.
