Actually there is a legal case to answer. If a bank undercharges you for something, legally they have every right to pursue you for the correct amount, and in a courtt of law if need be. I appreciate where you are coming from as i have been in this same situation a while back as i run a business. However, I wouldn't have wasted time writing about this on public forums when you could have gone legal instead and probably be on your way to getting your money back by now. I find the threat of legal action usually stirs people into action.
As much as i feel for you and the fact you have trusted someone to do the right thing there is a time and a place for this, but i don't think this is it.

not sure of the rights or wrongs of posting this on a public forum, but it appears to be a very straight forward mistake that needs rectified regardless.................
however, personally i know i could not be ar$ed to go 'legal' for something so trivial and would definately invest my time in far more rewarding things than chasing some idiot for what is rightfully mine - my time is far better invested in good honest customers

I don't know the guy but, unless someone's actually told him, he may be totally oblivious to what's happened. If he's anything like me, I rarely look at the amount I'm being charged and only skim through the CC statement. Stupid I know but that's me :roll:

From my original account of the situation above, I have had 2-way conversations with his missus and he has had PM's on at least 3 forums. I appreciate i owed you money Christian and i never said i didnt or wouldnt repay this amount.
However as Jayne stated i wasnt in the country for work reasons and had very little contact with her or anyone else for that matter.
I had to arrange for my company, who view me as a very small matter to pay my monthly pay into her account, just for her to live and attempt to pay the mortgage.
I then as soon as i knew i had sufficient funds in place gave her my card details to contact you.
When i get back im greeted when opening my mail with a northampton court summons!!
Nice... btw i spoke with a friend who happens to be a solicitor regarding this matter and she stated that their is no case :!:
It was an error on your behalf not mine, thus is the same thing as leaving a shop with incorrect change.
However i never refused to pay what i owed :!: :!:

Andy, I was WAY WAY more patient than anyone else would have ever been. With having had two-way contact with Jayne, I breathed a sigh of relief, but when she stopped replying to me, what was I to think? What would you have thought in the same position?
I let the early April date (3rd) that she assured me that this bill would be paid by pass considerably and with at least 2 warning messages and at least a week passing after this date before I went public. You/Jayne chose to ignore that warning, so what was I to do?
Whether or not it was my fault, we aren't your typical retailer, we are a tuning garage that is doing its best to look after its faithful club members and my repeated attempts to collect this shortfall in an amicable manner became tiring and time-consuming.
Anyway, the bill is now settled and as Rolty said, this is no longer a matter for public discussion.
