Ripped off on ebay!

I thought i,d bought some rare blue newage sti dials last week. They turned up today and turn out to be normal black sti dials!!! and they are scratched. I,ve emailed the seller so waiting for a response as the item i received is not what his picture shows or how he describes it. Anyone know how i resolve this? First time i,ve had a problem.

'Item not as described'

File a dispute via eBay, get them involved. Seller then has 10days to reply and make reparation by way of a full refund. If this doesn't happen then Escalate this to a claim via eBay. There is a procedure and it takes time but you will get your money back eventually. All in it can take 2 or 3 weeks unfortunately if you cannot sort this out amicably with the seller.

During the dispute you should ask the seller for a full refund to include original postage and postage costs to be incurred for returning the item.

Distance selling law clearly states the seller cannot demand you send the item back before he refunds you. If the seller won't refund your postage costs to return the item as part of the full refund you are entitled to tell him to pick it up in person. this is within distance selling rules and regs

You're in the right therefore eBay is on your side. Don't worry about it, just go through the motions and don't get angry!!

It doesn't matter a toss who sent it, your contract is with the seller therefore he has no choice but to comply one way or the other!!

Thank you kind sir, he has told me to send it back today. I emailed him pictures to show damage and wrong part so hopefully things will get sorted soon.

Has he agreed to include your postage costs to send it back on top of the full refund??

I hope he is an honourable seller and refunds your money as soon he receives the item.

I normally get proof of receipt or send by recorded delivery to show it's been posted, email the seller a pic of the postage receipt and then ask for my refund!!

If the seller hasn't refunded your money within the next few days and doesn't respond to your eBay messages, go direct to the eBay resolution centre and start proceedings.

Don't wait for him to respond to emails otherwise it takes an age to resolve the problem.

What he says............ also you have to log your complaint with Ebay within 45 days to qualify for a future refund .
Also one thing to add is ask him for a contact phone number as ( from experience ) it is better to talk to someone that have a ... email chat.

IMHO swapping contact numbers is not always a good idea, specially if the seller is being an arse. The seller may well use your phone number for things other than amicable communication.

Equally most people don't record their phone conversations so there is no record of what has been said or agreed.

At least by email you have a written electronic record which is indisputable that you can send to eBay as evidence of what has been communicated if any communication has taken place.

If the seller was a nice chap you could sort it all out with a couple of quick eBay messages and bingo, job done. Some sellers post telephone numbers on their listing which makes life even easier and no doubt after a quick phonecall it's all sorted.

However, as the buyer is entering into an eBay dispute and baring in mind comments already posted here by the buyer, it may be unlikely this dispute can be sorted amicably in which case an eBay dispute and claim is the only way, and written lcommunication in my honest opinion is the best way.
