DIVORCE !!!!!

I need some advice/help with a divorce matter. Any experts/people that know anything that can help.

This is the situation.

A family member is getting divorce. Before it has gone to solicitors they have agreed on who gets what etc.

but when one party started legal preceedings they were told that the offer was to generious.

so party a gets

the house and nothing more. est value

when i got mine we both agreed on who got what and to half the house value. there where no q's asked and it all went through no probs. if its all agreed up front then it goes through pretty quick. mine was all finnished within 7 months with no probs. :grin: oh see if they can get legal aid aswel save you loads.

or you could wait 2yrs and then get a divorce stating irreconsileable differences? excuse spelling!

I think then that the agreement already drawn up and agreed by the 2 parties will be valid?

I may be wrong and when it happened to me I was just glad to get away from the guy so was happy to leave with nowt :)

I would guess that Party B has started proceedings?

From my experience, solicitors have their own wellbeing at heart and will try to wring as much as possible from the split. If it goes ahead as arranged then the legalities are a formality and Party A & B walk away happy and with minimal legal fees.

I did a similar thing first time and it all went through smoothly with no fuss, but the second was a protracted, expensive affair and the only winners were, guess who?

I'd advise for them to stick to their agreement and find solicitors who will abide by their instructions. There must be some about who'll listen.

Personal opinion, of course :-D

I've just gone thru a break up, not a divorce and we managed to agree on everything which made it alot easier. I was determined not to let it get nasty as like Gerry H says the only people usually to benefit are the solicitors. Speaking to friends who have been in this situation, it seems that because they are looking after there clients supposed best interest a lot of letter ping pong is played. This results in lots of money for the solicitors. I read somewhere that the average divorce is around 27k!
In reality perhaps I was too generous, but I would rather come out with something rather than nothing.

I did get a signed agreement between the both of us which was witnessed at the solicitors for peace of mind, this gave clear indication as to who got what regards split of house,money,shared debts etc etc.
