I always use the IVA / SVA as a reference as it's the european guidelines for a road legal car, the BIVA is the basic one for personal imports and amature built cars. Within that document for example the emmisions (and subsequent tax band) for that car is actually based on the engine not the car so if you put a 2005 porsche engine into a '68 bug then have to stick it through a BIVA the emissions should be for a 2005 porsche.

It's a grey area really and unfortunately it's a case of they assume the current regulations unless YOU can prove otherwise i.e. it's an engine from a '89 so doesn't need a cat or is a 70's engine so it just needs a visual emissions check. In kit car circles it's a great sticking point during registration and testing.

If I was in the situation I would be citing the IVA regulations at 99db unless they can produce a manufacturers document for that specific make and model
